Welcome to Fatboy Prints. These Terms and Conditions (“Terms”) govern your access to and use of FatBoyPrints.com and your purchase of products from us. By using the site or placing an order, you agree to these Terms.
1. Eligibility
You must be able to form a binding contract under applicable law to place an order. If you use the site on behalf of a business, you represent that you have authority to bind that business.
2. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly of any unauthorized use.
3. Products & pricing
We sell custom and stock apparel and related merchandise. Product images, colors, and mockups are illustrative; actual print appearance may vary slightly due to garment dye lots, screen calibration, and print processes. Prices, promotions, and availability may change without notice until you complete checkout and payment is accepted.
4. Orders & payment
Submitting an order is an offer to purchase. We may decline or cancel an order for reasons including suspected fraud, artwork issues, inventory/production limits, or pricing errors. Payment is processed by Stripe. You authorize us (and Stripe) to charge the payment method you provide for the order total, including shipping and taxes where applicable.
5. Custom artwork & personalization
When you upload artwork, use our design studio, or enter personalization (for example a name on a mug or shirt), you represent and warrant that:
- You own the rights to the content, or have permission to use it for commercial reproduction
- The content does not infringe intellectual property, privacy, or publicity rights of others
- The content is not unlawful, defamatory, or otherwise prohibited
You grant Fatboy Prints a limited license to use your artwork and personalization solely to manufacture, fulfill, and support your order (including reprints when applicable). We may refuse artwork that we reasonably believe violates these Terms or applicable law.
6. Shipping & returns
Shipping timelines and return/reprint rules are described in our Shipping Policy and Return Policy, which are incorporated into these Terms.
7. Intellectual property
The Fatboy Prints name, logos, site design, and our original content are owned by us or our licensors. You may not copy or reuse them without permission, except for fair use or as allowed by law. Your uploaded artwork remains yours, subject to the license in Section 5.
8. Prohibited use
You agree not to misuse the site, attempt unauthorized access, interfere with security or operations, scrape the site in an abusive way, or use the service to produce infringing or unlawful goods.
9. Disclaimer of warranties
Except as expressly stated in our Return Policy or required by law, products and the site are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, Fatboy Prints and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the site or products. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
11. Indemnity
You agree to indemnify and hold Fatboy Prints harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your artwork, personalization content, misuse of the site, or violation of these Terms or third-party rights.
12. Governing law
These Terms are governed by the laws of the United States and the state in which Fatboy Prints principally operates, without regard to conflict-of-law rules, except where consumer protection laws in your jurisdiction require otherwise.
13. Changes
We may update these Terms from time to time. The effective date will be revised when changes are posted. Continued use of the site after changes constitutes acceptance of the updated Terms.
